A case (Z8:786) in the Chancery Court of New Jersey is very important in identifying the heirs of Zachariah, Jr., and Margaret Stickles. The case involved Zachariah M. Stickles of Stillwater township vs. Whitfield S. Johnson, Zachariah Stickles, et al, to have two tracts of land partitioned. Bill of complaint filed 8 Jan 1868.

I. In pursuance of a prenuptial agreement: Margaret Savacool, of Newton township with her husband Jacob Savacool conveyed to Whitfield S. Johnson of Newton township, premises in Newton township, by deed dated 1 Jan 1851 (M4:158) to be held in trust for use of Margaret Savacool, late Margaret Stickles as life beneficiary, and if she does not direct its sale in her lifetime, or in her Will, then it is to be conveyed to her heirs-at-law.

II. On 1 Dec 1845 Abraham Stickles and Esther his wife of Lafayette township with Zachariah Stickles of Newton township conveyed property in Lafayette to Zachariah Stickles by deed (E4:289) in trust for the benefit of Margaret Savacool.

III. On 9 May 1866 Margaret d. intestate leaving heirs-at-law: Zachariah Stickles, brother, of Andover township; Zachariah M. Stickles and Abram Stickles, nephews, of Stillwater township, sons of deceased brother Andrew; Eliza Williams, niece, wife of Amos Williams of Luzerne County, Pennsylvania, daughter of brother Andrew; George W. Orner, John Orner, Jacob Orner, Theodore Orner, all of Port Jervis, New York, children of Margaret Orner, deceased wife of Jacob O. Orner deceased, who was the daughter of brother Andrew Stickles; Catharine Porter, wife of William H. Porter of Stanhope, Salina Foster, wife of Jonathan Foster of Jersey City, Hudson County, Elizabeth Homler wife of Elisha Homler of Huntsville, all daughters of brother Andrew Stickles (this was later corrected as Catharine, Salina, and Elizabeth were all daughters of Margaret Stickles Orner); Isaac Stickles of Warren County and Margaret Reed wife of Abram Reed of Andover, children of deceased brother, Philip; Elizabeth Allen wife of Richard Allen, residence unknown, but who is supposed to reside in Indiana, sister. Elizabeth Homler and Guy Homler are minors under 21 years. During the year 1867 John Orner died leaving Ida M. Orner his only child and heir-at-law, an infant under 21 years of age. IV. All parties wish the premises to be sold and the proceeds divided.

Subpoenas were served on Isaac Stickles by A. R. Metz, sheriff; Zachariah Stickles, Abram Stickles, Guy Orner, William H. Porter and Catharine his wife, Elisha Homler and Elizabeth his wife, Abram Reed and Margaret his wife by Jesse Ward, sheriff of Sussex County, New Jersey; Jonathan and Salina Foster cannot be found in Hudson County and are believed to reside in New York state.

Guy Orner, Ida M. Orner, and Elizabeth Homler are minors between the ages of 14 years and 21 years. Barker Gummere appointed guardian.

Thomas Anderson, attorney for the plaintiff has been unable to find Amos and Eliza Williams or Richard and Elizabeth Allen. The addresses of Jacob Orner, George W. Orner, and Theodore Orner is Port Jervis, New York.

The defendant Zachariah Stickles died a few days after being served the subpoena in the case. He left a Will and devised to his four sons, Philip, Charles, Steward, and Daniel H., all his interest in the case, Steward and Daniel qualifying as executors of the estate of Zachariah Stickles.
